Lets Talk About Home Loan

Home Laon

In 90% of the resale transactions, either seller has the loan or buyer wants to take loan or both. Home Loans plays a very crucial part in the execution of a resale transaction. Property Station's property advisors guide their clients in the whole process of taking home loan from all banks. There can be 3 types of cases involving home loans in a resale property transaction.

Case Continue

Case 1
Seller does not have any loan; buyer wants to take loan When the seller does not have any home loan on the property, it means the property papers are with him only and there is no mortgage on the property. In this case, buyer does not have any dependency on the seller and can choose any bank for taking home loan depending on the competitive interest rates and market valuations.

Case 2
Seller has loan; buyer does not want to take any loan When the seller has the loan on the property he wants to sell, his property documents are mortgaged with the bank. If the buyer does not want to take any loan to purchase the property, the seller has to close the loan to get his property documents released from the bank and get the transfer/registry done of the property. Loan can be closed by any of the three options

(1) Seller pays off the loan from his own funds.
(2) Buyer pays the amount at the agreement to sell to seller and seller pays off the loan
(3) Buyer and Seller both contribute to pay off the loan and get the documents released from bank.

Case 3
When Seller has the loan on property and Buyer also wants to take loan. In 70% of the property transactions, this situation occurs when seller has a running loan and buyer also wants to take loan to buy the property. In this scenario, there can be 2 situations.

More Situation

Situation 1

When the seller has loan from any Bank and buyer also want to take it from the same bank. In this situation, when the seller has an existing loan from (For e.g. ICICI Bank) and buyer also wishes to take the loan from the same bank, buyer applies the loan from the same bank. Once the buyers loan is sanctioned, both buyer and seller give the request for loan transfer and the loan gets transferred into the buyers name. Property documents were already with the bank and transaction gets completed.

Situation 2

When the seller has loan from (For e.g. ICICI Bank) and buyer want to take it from the any OTHER bank In this situation, when the seller has an existing loan from (For e.g. ICICI Bank) and buyer wishes to take the loan from the any OTHER bank (For e.g. HDFC Bank), because of some better interest rates or higher market valuation or any other purpose When this kind of situation occurs, seller has to do the balance transfer of his loan to the bank from where buyer wishes to take loan.

In Balance Transfer, seller applies the loan in buyers preferred bank and gets it sanctioned. Once the sellers loan is sanctioned, bank disburses his loan and pays the amount to his existing lender. Once the documents are returned by the existing lender to new bank, then the whole procedure mentioned in Situation 1 is executed.
